What Is Considered a Multiple DUI?

In Tennessee, a second, third, or subsequent DUI offense is referred to as a “multiple DUI.” If you have been previously convicted of this offense, you will face enhanced penalties for a subsequent conviction.

Under Tennessee law, the following convictions count as “previous convictions” for multiple DUI purposes:

  • Convictions that occurred within the past 10 years
  • Convictions that occurred in another state and involved similar laws

Multiple DUI Penalties

The specific penalties for a multiple DUI conviction depend on how many previous convictions you have. The more previous convictions you have, the more severe the penalties will be.

Penalties for a second DUI conviction within 10 years of the first conviction include:

  • Between 45 days and 1 year in jail
  • A fine between $600 and $3,500
  • 2-year driver’s license revocation
  • Mandatory installation of an ignition interlock device (IID) in your vehicle

Penalties for a third DUI conviction within 10 years of the first conviction include:

  • Between 120 days and 1 year in jail
  • A fine between $1,100 and $10,000
  • 6-year driver’s license revocation
  • Mandatory installation of an IID in your vehicle

Penalties for a fourth or subsequent DUI conviction within 10 years of the first conviction include:

  • Between 150 days and 6 years in jail
  • A fine between $3,000 and $15,000
  • 8-year driver’s license revocation
  • Mandatory installation of an IID in your vehicle

In addition to these penalties, you may also be required to complete an alcohol or drug treatment program, perform community service, and/or attend a DUI education course. You will also have a permanent criminal record, which can make it difficult to secure employment, housing, and other opportunities.
